<p>The Department for Transport’s data on road accidents collected from police STATS19
returns reporting personal injury road collisions does not collect definitive information
about whether any of the road users involved in a collision were breaking the law.</p><p>
</p><p>There is information in the STATS19 database to indicate, in the opinion of
the police officer attending the scene, what contributory factors might have played
a part in a particular road collision. However, this information is not recorded for
all collisions and is based on the officer’s initial opinion assessment only before
any legal action has taken place. In addition, information about breath test results
at the scene is collected but there is no record of whether this led to a prosecution
or conviction.</p><p><br>Data on prosecutions are collected by the Ministry of Justice.</p><p>
